Terms and Conditions, 01/01/2022

GENERAL

The following terms and conditions are part of all offers and contracts for deliveries and services of the company San Vision Mannequins by mutual agreement.

The terms of payment and delivery apply to shipping within the European Union. I reserve the right to exclude individual countries from shipping.

TERMS OF SALE

Our offers are aimed at commercial and private customers. All offers and agreements are based on our conditions; they are deemed to be accepted when the order is placed.

Deviating conditions of the customer are not binding for us, even if we do not expressly object to them. Orders accepted by us are binding for the customer. Offers are always subject to change and non-binding in terms of prices and delivery.

The goods sold remain our property until all claims against the customer arising from this contract have been fulfilled.
All illustrations, weights and dimensions in our offers are only approximate unless they are expressly designated as binding. The goods are subject to prior sale.

No installment payments and no payment breaks. The goods must be paid for within 14 days.

Any ancillary costs of money transactions (e.g. PayPal, foreign transfer costs, etc.) shall be borne by the buyer. Jurisdiction and place of fulfillment for delivery and payment is Wuppertal. The law of the Federal Republic of Germany applies exclusively, the validity of the UN Sales Convention is excluded.

DELIVERY / SHIPPING

Shipping takes place 5-7 days after receipt of payment, unless a different date has been agreed.

Delivery periods are agreed as approximate, assuming that we are properly supplied by ourselves. Compliance with our delivery obligation presupposes the proper fulfillment of the buyer's obligations. 

Upon receipt, the goods must be unpacked immediately and checked for possible transport damage. The customer must notify the carrier (Deutsche Post) and us immediately of any transport damage.

We assume no liability for transport damage. Will be delivered with DHL as an insured package. Further claims of the buyer - also those from § 437 No. 3 BGB - are excluded. We are therefore not liable for damage that has not occurred to the delivery item itself, in particular we are not liable for lost profits or other financial losses of the buyer.

All prices include VAT, which is shown separately on the invoice.

Data protection: The data provided by our customers will only be used to process ordinary business operations.

RIGHT OF WITHDRAWAL FOR DELIVERIES WITHIN THE FEDERAL REPUBLIC OF GERMANY

Right of withdrawal:

You can revoke your contract declaration within 14 days without giving reasons in text form (e.g. letter, e-mail) or - if the item is left to you before the deadline - by returning the item.

The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and not before we have fulfilled our information obligations in accordance with Article 246 § 2 in conjunction with § 1 Para. 1 and 2 EGBGB as well as our obligations according to § 312e Para. 1 Clause 1 BGB in connection with Article 246 § 3 EGBGB.

The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

Consequences of revocation:

In the event of an effective revocation, the services received by both parties must be returned and any benefits (e.g. interest) surrendered. If you cannot return the service received to us in whole or in part, or only in a deteriorated condition, you may have to pay us compensation for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to their inspection - as you would have been able to do in a retail shop. In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as if it were your property and refraining from anything that would impair its value. Transportable items are to be returned at our risk.

You have to bear the costs of the return if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item at the time of the cancellation, you have not yet received the consideration or a contractual have made the agreed partial payment. Otherwise, the return is free for you. Items that cannot be sent by parcel will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the item, for us with their receipt.

FINAL PROVISION

If one or more provisions of these general terms and conditions are or become invalid, both the contract and the remaining terms and conditions remain effective.
